INDEMNITY AND ASSUMPTION OF RISK NOTICE

BARBADOS HASH HOUSE HARRIERS

By participating in any event organised by the Barbados Hash House Harriers (“the Event”), the participant agrees as follows:

1. Assumption of Risk

The Participant acknowledges that participation in the Event involves inherent risks, including but not limited to uneven terrain, physical exertion, environmental conditions, and other foreseeable and unforeseeable hazards.

The Participant voluntarily assumes all such risks and accepts full responsibility for any injury, loss, or damage that may arise from participation.

2. Limitation of Liability

To the fullest extent permitted by law, the Barbados Hash House Harriers, its officers, agents, and servants shall not be liable for any loss, damage, injury, or death suffered by the Participant arising out of or in connection with participation in the Event.

Nothing in this agreement excludes liability for death or personal injury caused by gross negligence or wilful misconduct.

3. Participant Responsibility

The Participant agrees to act responsibly and with due care at all times during the Event and acknowledges that they are solely responsible for their own actions and decisions.

4. Liability to Third Parties

The Participant shall be liable for any injury, loss, or damage caused to third parties or property arising from their negligent or wilful acts or omissions during the Event.

5. Insurance

The Participant is responsible for arranging their own insurance cover, including but not limited to personal accident, medical expenses, and third-party liability.

6. Indemnity

The Participant agrees to indemnify and hold harmless the Barbados Hash House Harriers and its officers, agents, and servants from and against all claims, demands, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with any liability incurred by the Participant under this agreement.

7. Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Barbados.
